CONTROL AND SUPERVISION IN THE FIELD OF PROVIDING RIGHTS AND FREEDOMS IN PLACES OF LOCATION OF FREEDOM OF THE MIA OF UKRAINE

Abstract

The article, based on a comprehensive systematic analysis of current legislation that ensures the implementation of constitutional norms, considers the issue of control and supervision in the sphere of ensuring the rights, freedoms and legitimate interests of persons in places of forced detention by the Ministry of Internal Affairs of Ukraine. The methodological basis of the article made up of general scientific, private and special methods of cognition, the main one of which is the dialectical method. The object of the study is social relations that formed in the sphere of ensuring the rights, freedoms and legitimate interests of persons in places of forced detention by the Ministry of Internal Affairs of Ukraine by means of control and supervision. It indicated that the improvement of the regulatory and legal framework requires a deep understanding and should be included in the area of attention of the legislator and the subjects of human rights activities in order to optimize control and supervision on their part, on human rights. This is due to the strengthening of the role of the subjects of national human rights protection activities regarding the implementation of the legislation, which guarantees the implementation by persons in places of forced detention of their rights, freedoms and legitimate interests. Considered in detail: parliamentary, presidential control, control of the Cabinet of Ministers of Ukraine, other bodies of executive power and local self-government, public control. In order to optimize measures to ensure the rights, freedoms and legitimate interests of persons in places of forced detention, the Ministry of Internal Affairs of Ukraine proposed new approaches to improving legislation and organizing the activities of legal protection entities, which provide for the codification of legislation that would coordinate the activities of entities that must to directly ensure rights, freedoms and legitimate interests in the specified specialized institutions.
