THE PROBLEMS OF IMPLEMENTATION OF CERTAIN ORGANIZATIONAL AND LEGAL FORMS OF ENSURING ENVIRONMENTAL SAFETY UNDER THE CONDITIONS OF MARITAL STATE AND PROSPECTS FOR IMPROVEMENT

Abstract

The article is devoted to the study of the current state of such basic organizational and legal forms of ensuring environmental safety as strategic environmental assessment and environmental impact assessment. Ways to improve national legislation are also determined. It defines the legal basis for the implementation of these organizational and legal forms of ensuring environmental safety, taking into account the European Green Course. Strategic environmental assessment is an important tool. It makes it possible to identify and take into account factors or possible consequences of policies, programs, strategies, other state planning documents for the environment, including public health, and accordingly develop measures to prevent, reduce and mitigate possible negative consequences, needs improvement conducting procedure, increasing its transparency, introducing responsibility for failure to carry out a strategic environmental assessment. It is noted that the creation of the Unified register of strategic environmental assessment will allow to systematize and make available to the public information on strategic environmental assessment of state planning documents It was investigated that the introduction of martial law in Ukraine led to the establishment of restrictions on certain constitutional rights and freedoms of a person and a citizen. Among them are limitations in the environmental impact assessment procedure. The updated regime for providing access to environmental impact assessment documentation for the purposes of participation in the procedure significantly limits the rights and opportunities of the public, and violates a number of international obligations and provisions of national legislation. Limiting the operation of the public register is not the same as limiting access to the document. It was concluded that when planning the post-war recovery of Ukraine, the environmental component must be taken into account. The principle of sustainable development should be fundamental for forming programs and drawing up a list of measures. The implementation of tasks, projects and measures of the national program “Reconstruction of a clean and protected environment” in the context of the Recovery Plan of Ukraine should ensure the implementation of environmental policy in accordance with the European integration direction of Ukraine’s development and the European Green Course.
