ENSURING THE ERADICATION OF GENDER-BASED VIOLENCE IN THE SECTOR OF SECURITY AND DEFENSE UNDER THE CONDITIONS OF MARTIAL STATE

Abstract

The article is dedicated to ensuring the eradication of gender-based violence in the security and defense sector. Since this is a structural and global phenomenon that has a social, economic and transnational character and concerns a serious violation of human rights. The article examines gender-based violence against women and girls and determines that it is not only a cause, but also a consequence of gender inequality, which is often reinforced by discriminatory legal and social norms that exclude women and girls from society. National legal and international acts related to ensuring the eradication of gender-based violence are considered. The classification of gender-based violence in the conditions of armed conflict (martial law) based on international legal acts in the field of human rights protection and in the field of protection of victims of armed conflicts is also given. This paper also examines criminal liability for gender-based violence in situations of armed conflict, postconflict settlement, and forced displacement. Institutional support for the eradication of gender-based violence in the security and defense sector in Ukraine under martial law is also considered. It is highlighted which function in relation to ensuring the eradication of genderbased violence is performed by: the President of Ukraine, the Verkhovna Rada of Ukraine, the National Security and Defense Council of Ukraine, the Government of Ukraine, the Ministry of Internal Affairs of Ukraine, the Ministry of Defense of Ukraine, the Security Service of Ukraine, the Ministry of Justice of Ukraine, the Commissioner of the Verkhovna Rada of Ukraine on human rights, the Government Commissioner for Gender Policy, local public authorities and others.
