COMBATING CRIME IN THE CONDITIONS OF WAR: ANALYSIS OF STATISTICAL DATA (2013–2023)

Abstract

Effective criminal law regulation in the conditions of war acquires exceptional importance, victory requires rational use of social resources. Qualitative updating of methods of working with data is one of the main vectors of the development of modern science. The wide implementation of information technologies in almost all spheres of social existence ensures the formation of significant volumes of data, creates unique opportunities for the analysis of social processes. The substantiation of provisions about crime, its causes, the personality of the criminal, prevention measures, which involves methodologically consistent acquisition of new knowledge from data collected and processed automatically, is proposed to be called computational criminological reasoning. The possibilities of computational criminological reasoning were demonstrated using the example of the developed online statistical data analysis tool. An analysis of the impact of the Russian military aggression on the fight against crime in Ukraine was carried out in the area of effective use of social resources to fight crime. It was established: the need to increase the effectiveness of combating fraud, illegal drug trafficking, corruption, knowingly false reports of danger, forgery of documents; growing importance of a complex response to the problem of military personnel who commit criminal offenses; a gradual increase in the share of those exempted from punishment for illegal actions with weapons, which actualizes the problem of liberalization of the legal circulation of weapons; inconsistency of goals and forecasts of social effects of criminalization with the trends of practical criminal law regulation (Articles 436-2, 111-1 of the Criminal Code); signs crime prevention primitivization. Work with statistical data revealed significant shortcomings of the current system of collecting and analyzing data on combating crime. It is critically important to improve the information provision of criminal law regulation. It is proposed to create a complex information support system for criminal law regulation and develop an alternative system for evaluating the effectiveness of law enforcement and judicial bodies, which is not based on the analysis of official statistical data.
