ENSURING PUBLIC SECURITY AS ONE OF THE SPHERES OF NATIONAL SECURITY DURING THE ACTION OF THE STATE OF MARTIAL

Abstract

In the article, the author examines the problematic issues of ensuring public security as a national security sphere during martial law. First, the author is faced with conflicts in the legislation regarding the use of the terms "public safety", "public order", "public safety" and "public order", which in turn complicates the interpretation of legislation and the use of norms. Analyzing the scientific works of domestic scientists and current legislative acts, the author concludes that the concepts of "public safety" and "public safety" are interchangeable and interprets this term as the protection of interests, rights, and freedoms of a person and a citizen vital to society and the individual, the provision of which is a priority task of the security forces, other state bodies, local self-government bodies, their officials and the public, who carry out coordinated measures to implement and protect national interests from the influence of threats. Secondly, the author provides arguments that public security is a sphere of national security, which implies that the subjects who are called to ensure national security are also assigned responsibilities and the latter are empowered to ensure public security under martial law. Thirdly, the article examines the peculiarities of ensuring public security during martial law and the rights, duties, and powers of the subjects of its provision. The author gives examples of special rights granted to subjects of public security during martial law. The article also mentions the interaction between the National Guard of Ukraine and the National Police of Ukraine to ensure public safety in peacetime and during the operation of a special legal regime of martial law. In the conclusions, the author suggests enshrining the concept of "public security" in the legislation of Ukraine and offers his interpretation of this term, notes the list of subjects entrusted with the duties of ensuring public security during martial law, indicates the peculiarities of the application of the latter's rights and powers. Makes suggestions for further research on the selected issue.
