PUBLIC DANGER OF ACCEPTANCE OF AN OFFER, PROMISE OR OBTAINING AN IRREGULAR BENEFIT BY AN OFFICIAL PERSON

The article is devoted to the study of the public danger of accepting an offer, promise or receiving an undue benefit by an official. The author substantiates the opinion that the criminalization of the offense provided for in Article 368 of the Criminal Code of Ukraine is directly related to a significant increase in the public danger of this corruption offense. The public danger of accepting an offer, promise, and obtaining an illegal benefit by an official is characterized as an integral component of the objective side of this corruption offense. The content is outlined and specifically defined manifestations of public danger of corruption offenses in general and the criminal offense provided for in Article 368 of the Criminal Code of Ukraine, in particular. It is substantiated that one of the manifestations of the social danger of accepting an offer, promise and receiving an undue benefit by an official is the leveling of the democratic principles of equality and social justice, as well as the undermining of the foundations of public trust in the state. It is proved that the determination of the public danger of the corresponding type of corruption offense, as well as any criminal offense, is of practical importance. It is substantiated that this level of social danger affects the choice of a specific type of punishment for a person who has committed a relevant offense. It is argued that the level of public danger of a criminal offense provided for by Article 368 of the Criminal Code of Ukraine is influenced by the person of the offender and the circumstances of the offense committed. The author reviewed individual examples from court practice in cases involving criminal liability for accepting an offer, promise, and receiving an illegal benefit by an official. On the basis of the conducted review, a conclusion was made about certain practical aspects of the public danger of the corruption offense provided for in Article 368 of the Criminal Code of Ukraine.
