SOME ISSUES OF THE PROVISION OF SOCIAL SERVICES OF PERSONS WHO HAVE BEEN VICTIMS OF DOMESTIC VIOLENCE

Abstract

The article examines the types of social services provided to victims of domestic violence. The need to apply a comprehensive approach to the functioning of the service provision system is substantiated in view of the state social standards, which determine the procedure for providing appropriate social services for persons who find themselves in difficult life circumstances. The classifier of social services identifies persons who have suffered from domestic violence by a recipient of social services for the following types of social services – provision of shelter, emergency (crisis) intervention and socio-psychological rehabilitation. A systematic analysis of the legislation regulating the activity of providers of social services to such persons shows that there is no limited list of such social services. However, it is possible to provide more of them, such as consulting, informing, providing asylum, and representing interests. It is proposed to add item 5, part 1 of Art. 14 of the Law of Ukraine “On the prevention and counteraction of domestic violence” with the following sentence: “The content and scope of social services for each victim is determined individually depending on his needs and is specified in the contract on the provision of social services in accordance with the standards for the provision of social services to victims, which are approved in accordance to the standards of providing social services to victims by the central executive body, which ensures the formation of state policy in the field of prevention and countermeasures against domestic violence, taking into account the requirements of international legal acts”. It is also worth duplicating in paragraph 5, part 1 of Art. 14 of the Law of Ukraine “On Prevention and Combating Domestic Violence”, the content of the provisions of Clause 4, Part 1, Art. 17 of this act. In particular, provide for general and special support services to provide social services to affected persons, including affected children, only with the consent of the affected persons or their legal representatives, and if the parents, other legal representatives of the child, legal representatives of the disabled person are offenders or evade the protection of rights and the interests of the child or disabled person – with the consent of the guardianship authority.
