FEATURES OF BORROWING INTO THE LABOR LEGISLATION OF UKRAINE LOCAL LEGAL PROVISIONS OF LABOR PROTECTION OF POLAND

Abstract

This scholarly article examines the legal nature and features of the incorporation of Poland’s local legal framework for occupational health and safety into the labor legislation of Ukraine. The system of legal regulation of labor relations, ensuring occupational safety, and guaranteeing fair remuneration in Ukraine requires substantial improvement due to the inconsistency of current legislation with contemporary social needs and its outdated provisions. Based on the conducted analysis, it is established that legal reform is not always effective, particularly when implemented without a unified objective and in an inconsistent manner. Reforming the legal framework for local regulation of occupational health and safety is an even more complex process, as it cannot be achieved solely through coercive measures; it necessitates the support of the participants in labor relations and a progressive approach to its perception. Consequently, the study of the specifics of Poland’s local legal regulation of occupational health and safety allows for the identification of various models of its legislative codification and its relationship with centralized legislation. At the same time, the issue of the peculiarities of local legal regulation of occupational health and safety in Poland remains insufficiently explored. It is further noted that in the context of widespread labor migration, driven both by the low level of workplace comfort in Ukraine and by challenging economic conditions, the adoption of Poland’s experience in local legal regulation of occupational health and safety enables more prompt and localized resolution of existing safety issues. The standards for occupational safety throughout Poland are uniform and highly stringent; therefore, studying the specifics of local legal regulation in different countries is aimed at determining ways to integrate them with the characteristics of national legislation and sociocultural traditions. Moreover, the study concludes that the positive experience of Poland’s local legal regulation of occupational health and safety can be adapted and implemented within the national Ukrainian practice.
