TYPES OF DEPARTMENTAL REGULATORY LEGAL ACTS OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

Abstract

The article examines the types of departmental regulatory legal acts of the Ministry of Internal Affairs of Ukraine, which are important elements of the departmental activities of law enforcement agencies. The relevance of the topic is due to the significant number of departmental regulatory acts of the Ministry of Internal Affairs of Ukraine, which differ in form, content, scope and legal consequences, as well as the lack of their clear regulatory consolidation at the legislative level. The article emphasizes that the practical significance of the classification lies in streamlining the regulatory array, preventing duplication of legal norms and simplifying their application in the law enforcement activities of law enforcement agencies, while the theoretical significance lies in the possibility of a deeper understanding of the legal nature, hierarchy and interaction of various types of departmental acts in the system of subordinate legislation. The scientific approaches of Ukrainian legal scholars to the definition of types of departmental regulatory legal acts, as well as the Law of Ukraine “On Law-Making Activities”, the Regulations on the Ministry of Internal Affairs of Ukraine, the Recommendations on the Preparation, State Registration and Accounting of Departmental Regulatory Legal Acts, which regulate issues of departmental regulatory legal acts, are analyzed. Special attention is paid to the problem of classifying departmental regulatory legal acts of the Ministry of Internal Affairs of Ukraine. Various scientific approaches to their division by form, subject of regulation, target orientation, procedure for adoption and nature of action are considered. The main forms of departmental regulatory legal acts are determined, such as orders, regulations, instructions, rules, decisions, lists. The conclusion is made about the lack of a unified approach to their classification and the need for further theoretical understanding and normative improvement of the legal regulation of departmental rulemaking in the sphere of activity of the Ministry of Internal Affairs of Ukraine.
