PECULIARITIES OF INTERROGATION OF CHILDREN VICTIMS OF HUMAN TRAFFICKING

The article is devoted to the study of procedural and forensic features of interrogation of minors who have suffered from human trafficking. The provisions of the Criminal Procedural Code of Ukraine, in particular Article 226, which regulates the interrogation of minors, are analyzed. The specifics of the psychological state of child victims of human trafficking, their trauma, and the peculiarities of interaction with law enforcement agencies are examined. The international practice of interrogating minor victims of crimes is studied, in particular the NICHD Protocol (National Institute of Child Health and Human Development), which is widely used in the USA, Great Britain, the Netherlands, Israel, and other countries. The provisions of the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse (Lanzarote Convention) and the Council of Europe Convention on Action against Trafficking in Human Beings are analyzed. It has been established that child victims of trafficking require a special approach during interrogation due to increased vulnerability, fear of traffickers, distrust of law enforcement, and post-traumatic stress disorder. The necessity of creating a comfortable environment for interrogation, applying open-ended questioning techniques, involving psychologists and social workers, and using specially equipped premises (“green rooms”) has been identified. Practical recommendations have been developed to improve the procedure for interrogating child victims of trafficking in Ukraine, taking into account international experience and national legislation requirements. The expediency of implementing structured interrogation protocols based on evidence-based methods, increasing the qualifications of investigators and prosecutors in working with traumatized children, and ensuring video recording of interrogations to minimize repeated procedural actions is substantiated.
