ADMINISTRATIVE PROCEDURE FOR OBTAINING THE LEGAL STATUS OF A PERSON MISSING UNDER SPECIAL CIRCUMSTANCES

The article analyzes the features of administrative proceedings regarding the acquisition of the legal status of a person missing under special circumstances – a person who disappeared in connection with an armed conflict, military operations, temporary occupation of part of the territory of Ukraine, emergencies of a natural or man-made nature. The procedure for submitting an application for the search for a person missing under special circumstances is studied. It is stated that the legally established list of persons who may submit an application for the search for a person (relatives of such a person, representatives of a military formation, state authorities, local self- government bodies, public associations and others) is inexhaustible, which allows any person (and these can be both individuals and legal entities) to initiate administrative proceedings regarding this category of administrative cases.It is emphasized that the administrative procedure for obtaining the legal status of a person missing under special circumstances involves a set of sequential actions initiated by the applicant and carried out by the National Police of Ukraine and other subjects of government authority. Among the problematic aspects of such a procedure, one should highlight the failure to comply with the sequence of actions of the applicant in the administrative proceedings (first there should be an appeal to the police, and then information is entered into the Unified Register of Persons Missing under Special Circumstances), as well as the procedure for verifying facts indicating that the person went missing precisely in connection with an armed conflict, military operations, temporary occupation of part of the territory of Ukraine, and emergencies of a natural or man-made nature. Regarding the latter factor, it is advisable to regulate the relevant procedure at the level of a separate subordinate regulatory legal act, which would determine the powers of each of the inspection subjects, the forms and terms of their interaction, and the grounds for refusing to recognize facts indicating the disappearance of a person under special circumstances.
