PERMIT SYSTEM AS AN ADMINISTRATIVE SERVICE FOR THE IMPLEMENTATION OF THE RIGHT TO OWN A FIREARM

Abstract

The article, based on a comprehensive system approach, examines the permit system in the context of administrative services for the implementation of the right to own a firearm. Improving state regulation of the circulation of firearms, which combines issues of licensing and permitting and preventive activities, state management in the field of weapons circulation determines the relevance of the study. The object of the study is public relations that develop in the field of activity of the executive authorities authorized in the field of weapons circulation regarding the rules for the circulation of firearms.The subject is scientific research in the field of activity of the executive authorities regarding the enforcement of the rules for the circulation of firearms, the legal norms regulating the specified activity. The essence of the permit system is connected with the purpose, which is to ensure public safety. It is proved that the single theoretical basis for the implementation of administrative services by the bodies authorized in the field of arms circulation regarding the circulation of firearms determines the intra- sectoral relationship of legal norms on arms circulation and legislation on administrative services and on administrative procedure. It is indicated that the relationship assumes the correspondence of the meaning and theoretical meaning of the elements of the conceptual apparatus of control and supervisory activities in the field of arms circulation to the meaning and theoretical meaning of these elements, enshrined in specialized legislation on administrative services, without allowing distortion. Permits are conditions for the implementation by individuals and legal entities of rights and legitimate interests regarding the acquisition, storage and possession of firearms. The prospect of the development of legal regulation in the field of arms circulation is associated with the use of information and communication technologies and the improvement of the Unified Register of Weapons of the Unified Information System of the Ministry of Internal Affairs of Ukraine.
